If you ask an employee to create and manage social media accounts to help market your goods and services, who owns the rights to those social media accounts if the employee leaves? The answer is .... wait for it....IT DEPENDS! In a recent 2023 Magistrates' Court decision, the employer asked the employee to create an Instagram account to post photos of the work done by the employee for the defendant. When the employee left the employer, she deleted all the Instagram posts and changed the handle to the account. The unhappy employer alleged that the employee breached her obligations in doing so. The Court disagreed and found that despite the employee creating the Instagram account in the course of her work, she created it with her personal email address and password, and there was nothing in her contract which assigned any administrative privileges in the Instagram account to the employer. Contrast this with a 2019 District Court decision in which the employer was found to be entitled to the Instagram account because it was the employer who set up the account and who gave the employee the login details to manage the account. Data shows that there are about 4.9 billion social media users worldwide in 2023. That is approximately half the world's population. Social media marketing is now an important component of business. It is not unusual for employers to rely on social media savvy employees to set up and run the employer's social media accounts. Rights to these social media accounts can be hotly contested if the employment relationship goes south. So what should employers do to pre-empt the issue? Is it just a question of who set up the account? Not necessarily. Like IP rights, employers would be prudent in ensuring that their employee's employment contracts assign the rights to social media accounts to the employer. For users facing online harassment, reporting abusive content to social media companies is one of the only means of defending themselves, protecting their community, and seeking accountability. For platforms, user reporting is a critical part of the larger content moderation process. And yet our research shows that reporting mechanisms on social media platforms are often profoundly confusing, time-consuming, frustrating, and re-traumatizing.Informed by nearly two dozen interviews and extensive analysis of reporting flows on Facebook, Twitter, TikTok, Instagram, and YouTube, Meedan and PEN America have joined forces to map out concrete, actionable changes platforms can make so that reporting is more user-friendly, effective, and trauma-informed. The work that Meedan does continues to be innovative and groundbreaking. Meedan is a global technology not-for-profit that builds software and programmatic initiatives to strengthen journalism, digital literacy, and accessibility of information online and off. They tackle difficult and complex challenges. Glad to be apart of philanthropy supporting them. “In a 2021 report, “No Excuse for Abuse,” PEN America outlined a series of recommendations that social media platforms could enact to reduce risk, minimize exposure, facilitate response, and deter abusive behavior, while maintaining the space for free and open dialogue. In doing that research, it became clear that the mechanisms for reporting abusive and threatening content to social media platforms were deeply flawed. In this follow-up report, we set out to understand how and why…“For this report, nonprofit organizations PEN America and Meedan joined forces to understand why reporting mechanisms on platforms are often so difficult and frustrating to use, and how they can be improved in concrete, actionable ways…“1. Create a Dashboard for Tracking Reports, Outcomes, and History“2. Give Users Greater Clarity and Control as They Report Abuse“3. Align Reporting Mechanisms with Platform Policies“4.
